These Terms and Conditions (“Terms”) govern your access to and use of our website https://nestpays.com (the “Platform”) and any related services provided by us.

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About NestPays

NestPays is an individual proprietorship based in Kelwa City, Rajsamand District, Rajasthan, India.
Our motto — “Monetize Your Creator Skills” — reflects our mission to help creators turn their skills and audience into income by selling digital products online.
The Platform allows verified creators to list, promote, and sell their digital content directly to customers.

2. Eligibility

To access or use the Platform:

  • You must be 18 years or older.

  • You must provide accurate, current, and complete information during registration.

  • By registering, you confirm that you have the legal authority to enter into this agreement.

NestPays reserves the right to suspend or terminate accounts that violate these Terms or provide false information.

3. Creator Account & Responsibilities

Creators are responsible for:

  • The authenticity and quality of their uploaded digital products.

  • Ensuring that their products do not infringe on any copyright, trademark, or third-party rights.

  • Maintaining the security of their account credentials.

  • Providing prompt support to their customers (if applicable).

NestPays is not responsible for disputes arising between creators and buyers.

4. Nature of Products

All items sold on NestPays are digital products only (such as eBooks, PDFs, templates, courses, files, etc.).
No physical products are sold or shipped.
All sales are final and non-refundable once access or download has been granted.

5. Platform Role & Limitations

NestPays functions solely as an intermediary digital marketplace that facilitates transactions between creators and buyers.
We do not own, create, or verify the digital products listed by creators.
NestPays is not responsible for the performance, accuracy, or legality of content uploaded by creators.

6. Commission Structure

NestPays charges a 7% commission on every successful sale made by a creator through the Platform.
This commission is automatically deducted before payouts are processed.
Creators are responsible for any applicable taxes related to their earnings.

7. Prohibited Content & Activities

Creators are strictly prohibited from uploading or selling:

  • Adult, pornographic, obscene, or violent material.

  • Copyrighted content without permission.

  • Misleading, fraudulent, or harmful digital products.

  • Any illegal, unethical, or deceptive content.

Violation of this policy may result in immediate account termination and legal action if required.

8. Payments & Withdrawals

All financial transactions on NestPays are processed via authorized payment gateways.
Currently, the platform may operate without an integrated gateway during its early phase.
When active, creators’ earnings (after the 10% commission) will be disbursed to their verified payment accounts as per NestPays’ payout policy.

NestPays is not liable for delays caused by banking systems, payment processors, or technical failures.

9. Refund Policy

Due to the nature of digital goods:

  • No refunds, replacements, or cancellations are offered once the digital product has been delivered or accessed.

  • Buyers must review the product details carefully before purchasing.

  • If a product is defective, buyers may contact support@nestpays.com, and our team will verify and assist accordingly.

10. Intellectual Property Rights

  • All intellectual property rights of the NestPays platform (including the brand name, logo, website design, and code) belong solely to Rakesh Nakum.

  • Creators retain ownership of their digital products but grant NestPays a non-exclusive license to host, display, market, and distribute their content on the platform.

  • Unauthorized copying, reselling, or redistribution of any digital content from NestPays is strictly prohibited.

11. Platform Use & Conduct

You agree not to:

  • Misuse or attempt to hack, disrupt, or interfere with NestPays systems.

  • Use automated tools, bots, or scripts to manipulate sales or downloads.

  • Engage in spam, harassment, or harmful communication within the platform or community.

Violations may result in suspension, termination, and potential legal action.

12. Accuracy of Information

While we strive to ensure that all information on our website is accurate, errors or omissions may occur.
NestPays reserves the right to correct, update, or remove any information at any time without prior notice.

13. Privacy & Data Protection

Your personal data is processed in accordance with our Privacy Policy.
We ensure that your information is handled lawfully, securely, and used only for legitimate business purposes.
By using NestPays, you consent to such collection and use of information.

14. Disclaimers

NestPays provides all services on an “as-is” and “as-available” basis without any warranties.
We do not guarantee that:

  • The platform will operate without interruption or errors.

  • The content or files will be free from viruses or harmful components.

  • Any particular financial result or income will be achieved by creators.

Creators’ success depends solely on their own efforts, marketing, and audience engagement.

15. Limitation of Liability

NestPays and its representatives shall not be liable for:

  • Any indirect, incidental, or consequential damages.

  • Any loss of data, revenue, or business arising from your use of the platform.

  • Any third-party misconduct or violation of laws by users.

Your sole remedy is to discontinue using the platform.

16. Indemnification

You agree to indemnify, defend, and hold harmless NestPays, and affiliates from any claims, damages, or liabilities arising from:

  • Your content or conduct.

  • Your breach of these Terms.

  • Any misuse of the platform.

17. Modifications to the Platform or Terms

NestPays reserves the right to:

  • Modify or discontinue any part of the platform.

  • Update these Terms at any time without prior notice.

Your continued use of the platform constitutes acceptance of the most recent version of these Terms.

18. Third-Party Services

The platform may contain links or integrations with third-party services.
NestPays is not responsible for the content, reliability, or practices of such external services.

19. Suspension & Termination

We may suspend or permanently terminate user access if we believe:

  • The account has violated any policy.

  • Fraudulent or illegal activity has occurred.

  • Misuse or harm to the platform’s reputation has been attempted.

Upon termination, all rights and access to products or earnings may be revoked.

20. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.
In case of any dispute, it shall be subject to the exclusive jurisdiction of the courts of Rajsamand, Rajasthan.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. Community Rules (Telegram / WhatsApp Creator Groups)

These rules apply to all members of official NestPays Creator Groups on Telegram or WhatsApp:

  1. Be respectful to all members and admins.

  2. Strictly no spam, self-promotion, or affiliate links.

  3. Share relevant, educational, or product-related content only.

  4. No adult, misleading, or copyrighted material.

  5. Keep discussions professional and confidential.

  6. Admins may mute or remove members violating these rules.

  7. Continued participation implies acceptance of future rule updates.
